1. Introduction
Welcome to OpenCommonsConduit ("we," "our," or "us"). These Terms & Conditions ("Terms") manage your engagement with our yacht charter services and website at opencommonsconduit.sbs (the "Service") provided by OpenCommonsConduit.
When you book a charter or use our Service, you accept these Terms. Should you not agree with any section of these terms, you are not authorized to utilize the Service.
2. Service Overview
OpenCommonsConduit offers a range of high-end yacht charter services that include, but are not limited to:
- Daily yacht rentals
- Sunset cruises
- Corporate retreats
- Private events
- Multi-day charters
Service availability is contingent upon weather patterns, and we maintain the discretion to alter or cancel services any time.
3. Booking and Reservations
3.1 Booking Process
Requirements for booking a charter include:
- Minimum age of 18 years
- Accurate and complete provision of information
- Deposit remittance as indicated in your booking confirmation
- Acceptance of these Terms & Conditions
3.2 Confirmation
Bookings are deemed confirmed only after payment is made and you receive our written confirmation. We reserve the full right to decline service to any individual at our own volition.
3.3 Availability
We are subject to yacht availability and favorable sailing conditions. Efforts will be made to meet your requested dates and times as closely as possible.
4. Payment Terms
4.1 Pricing
All rates are quoted in £ and incorporate applicable taxes unless indicated otherwise. Rates are liable to change without advanced notice.
4.2 Payment Schedule
- Deposit: 50% of the entire charter fee is due upon booking.
- Balance: Must be paid 48 hours prior to the departure of the charter.
- Any additional fees (if applicable): Payable at the end of the charter.
4.3 Payment Methods
We accept a variety of payment methods such as major credit cards, bank transfers, and certified cheques. Transactions are processed using secure, encrypted technology.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- Greater than 72 hours before departure: Full return excluding processing fees
- Between 24 to 72 hours prior to departure: 50% reimbursement
- Fewer than 24 hours before departure: No repayment available
5.2 Weather Cancellations
In an event where our captain deems weather conditions as unsuitable for sailing, we propose to:
- Rebook your charter for another suitable date without extra costs
- Issue a full refund if rescheduling is unattainable
5.3 Mechanical Issues
If mechanical issues arise with the vessel allocated to you, we will make efforts to supply an appropriate replacement. In absence of an alternative, a complete reimbursement will be granted.
6. Safety and Conduct
6.1 Safety Requirements
All passengers must:
- Adhere to all directives from the crew
- Dress in safety gear when stipulated
- Advise of any health conditions which could affect their safety
- Stay inside designated spaces on the vessel
6.2 Prohibited Items
The following items are not allowed on board:
- Glass containers
- Illegal substances
- Firearms or weapons
- Excessive amounts of beverages (beyond moderate consumption)
- Pets (unless pre-authorized)
6.3 Conduct
Passengers are expected to comport themselves respectfully. We reserve the right to end a charter prematurely with no refund if a passenger's conduct endangers safety or ruins the experience for others.
7. Liability and Insurance
7.1 Our Liability
Our accountability is confined to the amount paid for your charter. We are not liable for:
- Injuries sustained due to passenger negligence
- Loss of, or damage to, personal belongings
- Indirect, incidental, or punitive damages
- Delays due to weather or other factors outside of our control
7.2 Insurance Coverage
We keep comprehensive marine insurance that covers our vessels and operations. Passengers must have their own travel and property insurance.
7.3 Assumption of Risk
Participation in our charter services means recognizing maritime activities come with intrinsic hazards and you accept accountability for your personal safety and welfare.
8. Modifications and Itinerary Changes
We reserve the capability to adjust itineraries, courses, or schedules due to climatic conditions, safety imperatives, or operational exigencies. Every attempt will be made to provide alternatives of similar quality.
9. Force Majeure
We hold no obligation for interruptions, cancellations, or amendments prompted by conditions beyond our influence, inclusive but not limited to:
- Extreme weather patterns
- Natural calamities
- Governmental directives
- Port shutdowns
- Technical failures
10. Privacy and Data Protection
Your private data is managed per our Privacy Policy. By utilizing our services, you acquiesce to the compilation and use of your information as outlined within our Privacy Policy.
11. Intellectual Property
All materials on our website, such as text, imagery, trademarks, and logos, are shielded by copyright and related legal provisions. Unauthorized reproduction, dissemination, or derivative work creation is prohibited without our consent in writing.
12. Governing Law
Applicable laws in United Kingdom govern these Terms. Any disputes will be adjudicated in the courts of Southampton, United Kingdom.
13. Changes to Terms
We retain the right to alter these Terms when necessary. Revisions will be reported on our website, bearing a refreshed revision date. Continued service engagement post-modification signifies the acceptance of new terms.
